no. if they are down enough to die from a melee, and you are too. it doesn`t matter who melees first. the person with more health wins.

Doesn`t that mean you weren`t going to kill the person anyways?
If you have less health, and you melee someone with more health, they aren`t going to die either way. If they melee you, you`re going to die either way.
